Disclosure Statement

Annual Notice to Students: Consumer Information

The Higher Education Opportunity Act of 2008 mandates that schools provide an annual notice to all students and staff describing the availability of a wide range of consumer information. You may also get this information by visiting the Las Positas Financial Aid Office Building 1600, Room 1650.

The federal Higher Education Act, the federal Equity in Athletics Disclosure Act (EADA), and regulatory guidance provided in the Code of Federal Regulations (CFR) require direct individual notices of prescribed information to certain target audiences including prospective students, currently enrolled students, current employees, parents, coaches and counselors of prospective student-athletes, and the general public. Disclosures are to include crime/security statistics, student completion/graduation rates, FERPA privacy/security rights, financial aid program information, and gender-specific information on athletic participation and financial support.

These disclosures are updated annually prior to Oct 1. Availability of the disclosure is emailed annually to students at their Las Positas Email account. For a printed copy of the disclosure, please contact the Financial Aid Office in Building 1600, Room 1650or call (925-424-1585).

Information about Las Positas College

Las Positas College is located 40 miles southeast of San Francisco, amid one of California's fastest growing regions for business, science, and technology. Gently rolling hills and picturesque vineyards provide the scenic background for the College's 147-acre campus.

Las Positas College began as an extension center of Chabot College in 1963, offering 24 classes and enrolling 810 students at Livermore High School and two other sites. By 1965, the program had expanded and moved to Granada High School in Livermore. It subsequently grew to include Amador and Dublin High Schools as well. The District purchased the Livermore site that same year, intending to develop a comprehensive community college. On March 31, 1975, “Valley Campus” opened as the Livermore Education Center of Chabot College.

In 1988, the College was designated by the Board of Governors to be an independent college and on January 7, 1991, LPC received full accreditation from the Accrediting Commission for Community and Junior Colleges.

Overview

Las Positas College currently enrolls nearly 8,500 day and evening students. The College offers curriculum for students seeking career preparation, transfer to a four-year college or university, or personal enrichment. The College provides university transfer classes, retraining classes for those in need of employment or career advancement, a first-time educational opportunity for many adults, enrichment classes for those seeking a broader perspective, and career and technical training for those entering the technical and paraprofessional work force. Las Positas College excels in helping students transfer to the University of California system, the California State University system, and other four-year institutions.

Students who come to the College can choose any of 24 Occupational Associate Degrees, 17 Transfer Associate Degrees, and 44 Certificate Programs. In addition, the College offers community education courses geared toward personal development and cultural enrichment.

Academic rigor is maintained in a friendly, personal atmosphere. Las Positas College faculty and staff are distinguished by their energy, creativity, and commitment to making a difference in the lives of the students they serve.

The campus is accessible from BART and Interstate 580. Students can take buses from the Pleasanton-Dublin BART station and from many locations in Livermore and Pleasanton. Family Educational Rights and Privacy Act (FERPA)

The Family Educational Rights and Privacy Act (FERPA) of 1974, also known as the Buckley Amendment, protects the privacy of student records. The Act provides for the right to inspect and review education records, the right to seek to amend those records, and to limit disclosure of information from the records. The Act applies to all institutions that are the recipients of federal funding. Las Positas College, Financial Aid Office will not permit access to or the release of personally identifiable information contained in students’ educational records to any party without the written consent of the student, except as authorized by FERPA. Student may complete a fillable FERPA Release Form to release their information to a third party.

California Virtual Campus (CVC)

Las Positas College has achieved Teaching College status with the California Virtual Campus, making it easier for students across the state to seamlessly enroll in our online classes through the CVC Exchange.

For CVC Courses (Taking Classes at Other Colleges)

  • Consortium Agreement: If you're taking classes at Las Positas and another college in the same semester, contact Las Positas Financial Aid Office to set up a Consortium Agreement.
  • Home College: You generally apply for aid at your "home college" (where you take more units) and use the agreement to get funding for units at the other school.
  • CVC Exchange: Las Positas participates in the CVC Exchange, allowing combined units for aid, but you must contact Las Positas to confirm your CVC course is eligible

Constitution Day Information

In order to comply with the federal regulation requiring the development of educational programming to celebrate Constitution Day on September 17th of each year, Las Positas College's Student Government Office holds a 'Constitution Day' informational table and display on September 17th or, if on a weekend, the closest workday to September 17, in which constitutional information is provided and free copies of the U.S. Constitution are handed out.

Copyright infringement is the act of exercising, without permission or legal authority, one or more of the exclusive rights granted to the copyright owner under section 106 of the Copyright Act (Title 17 of the United States Code). These rights include the right to reproduce or distribute a copyrighted work. In the file-sharing context, downloading or uploading substantial parts of a copyrighted work without authority constitutes an infringement. Penalties for copyright infringement include civil and criminal penalties. In general, anyone found liable for civil copyright infringement may be ordered to pay either actual damages or “statutory” damages affixed at not less than $750 and not more than $30,000 per work infringed. For “willful” infringement, a court may award up to $150,000 per work infringed. A court can, in its discretion, also assess costs and attorneys’ fees. For details, see Title 17, United States Code, Sections 504, 505. Willful copyright infringement can also result in criminal penalties, including imprisonment of up to five years and fines of up to $250,000 per offense. Cost of Attendance

The cost of education is an estimated amount that a student will need to cover costs related to college attendance. Definition of Financial Need

Students are packaged for financial aid (given financial aid from several of the programs for which a student is eligible) based on the student’s financial need. Financial need is determined by a student’s Student Aid Index (SAI) (computed from information provided on the Free Application for Federal Student Aid) as compared to Las Positas College Cost of Attendance (COA). Those who have a positive number remaining after the SAI is subtracted from the Cost of Attendance may qualify for some need-based aid sources. To meet federal regulations, Las Positas College defines the neediest students as those whose SAI = $0.

Disbursement, Refunds, and Award Letter

Disbursement

Las Positas College has partnered with BankMobile Disbursements to deliver financial aid refunds and other credit balances to students. We are committed to delivering 100% of students’ refunds, providing students with clear choices and offering great customer service.

Refund choices include:

  1. DEPOSIT TO AN EXISTING ACCOUNT – Money is transferred to an existing account the same business day we receive funds from your school. Typically, it takes 1- 2 business days to credit the money to your account.
  2. DEPOSIT TO AN OPTIONAL BANKMOBILE VIBE CHECKING ACCOUNT – If you open an optional BankMobile Vibe Checking Account (upon identity verification), money is deposited the same business day we receive funds from your school

Refunds

Your actual refund (Pell grant payment) amount is based on your units of enrollment status. You will only receive the full award if you are enrolled full-time (12 or more units). If you are enrolled in fewer units, your award is adjusted based on enrollment level at the time your funds are authorized.

Please note: Before you can receive your refund, your financial aid file must be reviewed and completed. You must also meet the Satisfactory Academic Progress (SAP). Your refund will only be disbursed once your file is fully processed and you are in good SAP standings.

Important Information:

When you receive a notification that your financial aid funds have been disbursed, it means the funds have been sent to your student account to cover tuition, fees, or other charges. However, any remaining funds (your refund) will not be available until the scheduled refund date. Please note that the disbursement date and the refund date are different, and you may still need to wait a few days after disbursement to receive your refund.

Students will be paid on the Refund (Payment) Date once their financial aid file is complete and SAP requirements are met.

Withdrawal and Repayment: If a student withdraws after earning at least 60% of their grant, the student does not owe any repayment. However, students who earn no units in a term with a zero-grade point average (GPA) are subject to the same repayment regulations unless the student can document that they remained in class past the 60% point of the term. The repayment regulations are referred to as 'Return to Title IV.'

Late Start Classes and Financial Aid Refunds - When you enroll into late-start classes, your financial aid refund for those specific classes may not be available until the classes begin.

Drug and Alcohol Abuse Prevention Program

Las Positas College is committed to providing a drug free environment. The institutions also prohibit the use of tobacco products and electronic delivery devices on most parts of the campus and at college/district sponsored events (Board Policy 3570). A variety of community resources are available to students needing support around substance abuse. Eligibility for Financial Aid

Most financial aid is awarded and based on students’ having financial need. This need is used to determine eligibility. Financial Aid is predominately funded through the federal government. In order to qualify for financial aid a student must meet minimum requirements as referenced under FAFSA Eligibility.

Limitations to financial aid eligibility apply to those who already received a bachelor’s degree. These students may only gain eligibility for the California College Promise Grant (CCPG – Fee Waiver) and are not eligible for Pell grant funding.

Students who are enrolled in more than one school or institution at the same time may only obtain Pell Grant from one college. It may be possible for a school to pay a student enrolled in one of its eligible programs for courses taken at another eligible school, if those courses apply to the degree or certificate in the first school’s program. Emergency Response and Evacuation Procedures

Las Positas College Security and Safety Services issues timely reports to campus officials, regarding crimes, which pose an ongoing threat to other students or employees. These timely reports are available by request in the Campus Security office in Building 1700, Room 1725 or the Office of the Vice President of Administrative Services.  Las Positas Colleges also has the capability to send emergency text messages, emails and voice-recorded messages.

Federal Direct Loans

Terms and Conditions of Direct Loans

Terms and conditions of Direct Loans are included in the Borrower’s Rights and Responsibilities Statement, which the borrower receives upon completion of a Master Promissory Note with the Department of Education. The borrower may request another copy of their Borrower’s Rights and Responsibilities Statement at any time by contacting the Direct Loan Servicing Center.

Federal Student Aid (FSA)

The Federal Student Aid system (FSA) is the U.S. Department of Education’s central database for student financial aid records. Federal loans disbursed to students will be submitted to FSA and will be accessible by guaranty agencies, lenders, and institutions determined to be authorized users of the data system. Students can track and manage their federal student loans and grants online at StudentAid.gov. The secured site displays information on loans and grants, including amounts, outstanding balances and status. Student and parent borrowers can also find contact information for their loan servicer.

Terms and Conditions of Direct Loan Deferments

Information regarding the various deferments available to student and parent loan borrowers is available at the Department of Education web site – www.studentloans.gov under “Managing Repayment” and click on “Trouble Making Payments?”

Terms of Loans Received, Repayment Schedules, and Repayment

After graduating, leaving school, or dropping below half-time, there will be a six-month grace period before students are required to begin repayment. The loan servicer will notify the borrower of the date the first payment is due. If a repayment plan is not chosen by the borrower, the borrower will be placed on the standard repayment plan, with fixed monthly payments for up to 10 years. 

Borrowers may change their repayment plan at any time by contacting their loan servicer. Information about available repayment options—including Standard Repayment, Extended Repayment, Graduated Repayment, Income-Contingent Repayment, and Income-Based Repayment—can be found at www.studentaid.gov under “Loan Repayment.”

Loan Entrance Counseling

The Federal Government requires first-time student borrowers to complete loan entrance counseling to ensure that the student borrower understands the responsibilities and obligations they are assuming. In order to provide the required comprehensive information on the terms and conditions of the loan and the borrower’s responsibilities, first-time student loan borrowers at Las Positas College are required to complete online entrance counseling at www.studentaid.gov as part of their Direct Loan application.

Loan Exit Counseling

Las Positas College is required to provide counseling to federal student loan borrowers when the student ceases at least half-time study at Las Positas College. Student borrowers who fall below half-time units at Las Positas College are sent an email directing them to studentaid.gov to complete exit counseling and to receive information on monthly repayment amounts, repayment plan options, options to prepay or pay on a shorter schedule, debt management strategies, use of the Master Promissory Note, the seriousness and importance of student’s repayment obligation, terms and conditions for forgiveness or cancellation, terms and conditions for deferment or forbearance, consequences of default, options and consequences of loan consolidation, and tax benefits available to borrowers, as well as other necessary information.

Federal Student Loan Cohort Default Rate

A school’s cohort default rate (CDR) is the percentage of a school’s students who had certain federal student loans enter repayment in a federal fiscal year and then default before the end of the cohort default rate period.

Cohort default rates are based on federal fiscal years. Federal fiscal years begin October 1 of a calendar year and end on September 30th of the following calendar year. Each federal fiscal year refers to the calendar year in which it ends.

At Las Positas College, we are dedicated to promoting financial transparency and providing valuable information to our students and the community. As part of our commitment to openness, we have implemented a policy to disclose our Cohort Default Rate (CDR) on an annual basis, regardless of whether it rises above or remains below the national average. If Las Positas College CDR exceeds the national average, we will promptly notify identified Service Members via email of the updated CDR status.

Financial Aid Fraud

Las Positas College is committed to maintaining the integrity of the financial aid process. In accordance with federal regulations, we are required to report any suspected fraud or criminal misconduct related to Title IV financial aid programs to the U.S. Department of Education’s Office of Inspector General (OIG).

Fraud includes, but is not limited to:

  • Knowingly misrepresenting family or financial information on financial aid applications
  • Providing false or altered documents to obtain financial aid
  • Certifying false statements as true and correct
  • Manipulating the financial aid process for personal gain

Institutional Policy

Las Positas College will refer all suspected cases of fraud to the U.S. Department of Education’s OIG for investigation. The college is not responsible for making a final determination of fraud—only for reporting suspected cases.

Consequences of Financial Aid Fraud

Individuals found to have committed fraud may face:

  • Repayment of funds received through fraudulent means
  • Prosecution by federal authorities
  • Suspension or removal from Las Positas College

Financial Aid Study Abroad

If you enroll in a Las Positas College sponsored study abroad program, you may apply for financial aid through the Las Positas College Financial Aid Office. You will be considered for all aid programs (Pell Grant, Cal Grant, Student Success Completion Grant (SSCG), CCPG (California Residents), Foundation Scholarships and Loans, except Federal Work-Study).

Depending on the cost of your study abroad program, the financial aid you receive may or may not meet your full demonstrated financial need. To make up the gap between your aid and the cost of your program, you may want to apply for a private scholarship or an alternative loan. Please also contact the Study Abroad Office about application procedures and deadlines for Study Abroad Scholarships. You are responsible for making any payments for the program by the appropriate deadlines.

Graduation and Retention Rates for Student Athletes

Graduation and retention rates must be provided to student-athletes, their parents, high school coaches, and guidance counselors when an athletically related student aid offer is made. PCCD does not offer financial aid to students based on athletic ability. For information student-athletes, please contact the Athletic Department, in room G-237.

Las Positas College is committed to providing accurate, complete, and transparent information to current and prospective students. The College does not engage in substantial misrepresentation regarding its educational programs, costs, financial aid, graduate outcomes, accreditation, or relationships with external agencies.

The College ensures that information related to program requirements, transferability of credit, licensure eligibility, tuition and fees, financial aid, and employment outcomes is truthful and not misleading. Las Positas College also prohibits aggressive or deceptive recruitment practices.

How Do Net Price Calculators Work?

The calculator uses financial information that you provide to estimate the amount of grants, scholarships and other financial aid that is likely to be available to you. Your "net price" is the difference between that amount and the cost of attendance.

Many net price calculators also provide information about other kinds of financial aid you might be offered. These include loans and work-study jobs.

Resources Not included in Initial Award Packaging

Las Positas College may be informed from campus or external agencies regarding other financial aid programs requiring an adjustment to a student’s aid package. These may include Cal Grant, Student Success Completion Grant (SSCG), Chafee Grant, Foundation Scholarship or Off Campus Scholarship. These aid sources when added may require that other aid originally offered be adjusted (i.e. federal work study and student loan).

Return to Title IV Financial Aid

In accordance with Federal Regulations students who receive federal financial assistance and completely withdraw from all of their classes before completing more than 60% of the semester will be required to return any unearned federal funds.  As defined by the U.S. Department of Education, these students must have a Return of Title IV Funds (R2T4) calculation performed to determine the percentage of aid earned based on the amount of time the student was enrolled at Las Positas College. The amount of the return will be calculated on a pro-rata basis.

FWS earnings are excluded from the calculation. Students who do not begin attendance are “NO SHOW” and are not considered R2T4.

Las Positas is responsible for identifying students affected by this policy and complete a R2T4 calculation. The student will be informed, via email, of the results of the R2T4 calculation and any balance owed by the student. Las Positas College will return any unearned Title IV Institutional share within 45 days of the R2T4 calculation. At 45 days if the charge is unpaid by the student, the Financial Aid Office, will report the charges to National Student Loan Data System (NSLDS), 30 days after reporting to NSLDS, any unpaid balance will be assigned to the Department of Education for collection.

Las Positas College utilizes the grading symbol “FW” for students who have stopped attending and unofficially withdrawal. The Financial Aid Office will complete an R2T4 calculation based on the Last Day of Attendance (LDA) reported by the instructor. Additionally, if a student has any dropped courses in the semester, the Financial Aid Office will use the latter of the LDA of a “stopped attending F” course or the date of a previously dropped course. If an LDA cannot be determined, the Financial Aid Office will use the 50% point in the semester as the withdrawal date.

Las Positas College is not required to take attendance. Therefore, if the student has not earned a passing grade in any class and the Financial Aid Office is unable to determine the last date of attendance, the Financial Aid Office will use the 50% point of the period of enrollment as the withdrawal date.

If all F grades are listed on the report as N (student never attended), the Financial Aid Office will charge all aid at 100% since the student never began classes.

Overpayments will be reported to the National Student loan Data System (NSLDS) if:

  • The student fails to repay the overpayment within “45-day grace period”

In addition to posting on NSLDS for students who failed to repay their debt (30 days after reported to NSLDS), a separate assignment letter will be sent to the United States Department of Education (DOE) Debt Collection Agency and the appropriate actions will be taken to block students from receiving any additional Title IV funds until official verification has been received from the US DOE indicating that the overpayment will no longer prevent the student from receiving additional Title IV funds.

Post-Withdrawal Disbursements (PWD)

A post‐withdrawal disbursement may be required if the total amount of the Title IV aid earned as of the withdrawal date is more than the amount that was disbursed to the student. To be eligible to receive a post-withdrawal disbursement, students must have a complete financial aid file (verification completed and all tracking requirements satisfied) and meet all eligibility requirements. Upon notification that student has 14 days to request their funds.

Repayments

A student may owe a repayment of an overpayment when additional resources are received after aid has been disbursed, and the student has been determined to have received an over-award OR if it is discovered that the student has falsified any information in the application process.

  1. When a repayment is owed, the student is notified by email to their LPC Student email.
  2. Repayment of overpayments from federal grant programs may be made from future aid in the same award year if the student remains eligible for future aid.
  3. Students must make repayment during the semester of enrollment in which the overpayment is detected. To make repayment, the student must submit payment(s) to the Las Positas College Admission & Records Office.
  4. Students who fail to meet the provisions of repayment as agreed will be assigned to the Dept. of Education (D.O.E) and not be eligible for future financial aid until the debt is collected by D.O.E.
  5. All grant funds repaid by students are deposited by the Admission & Records Office into the appropriate accounts within 30 days of repayment.
  6. Repayments Due to Institutional Error: When the institution calculates and disburses the incorrect amount of a grant, the student is still required to repay, however it is not considered a Federal Overpayment. If the correction cannot be satisfied through the repayment process described above, the College will notify Admission & Records Office to reimburse the financial aid program through a local account and put the student in a receivable with the college.
  7. The Financial Aid Office will place holds on the academic transcript and other records until repayment is made and notify Admission & Records Office by memo when the debt is repaid. The Enrollment Office will then reimburse the account to reflect the repayment.

Assessed repayments will be refunded to the financial aid programs from which they were paid in the following order:

  1. Unsubsidized Direct Loan
  2. Subsidized Direct Loan
  3. Pell Grant
  4. Supplemental Educational Opportunity Grant

Monitoring Mid-Year Transfers

When awarding a student within the academic year, sometimes the Financial Aid Office determines that the student was not enrolled at Las Positas during the previous semester, (i.e. awarding for spring and the student was not enrolled in fall). In this case, Las Positas College checks NSLDS to calculate what the student was paid in Title IV aid, (Pell Grants, SEOG, and loans), and determines if any of the student’s scheduled awards need to be changed. These adjustments are made manually to keep the student awards within the federal limits.

Satisfactory Academic Progress (SAP) for Financial Aid

Effective for the 2014-2015 Award Year:  In accordance with Federal and State regulations, to qualify for and receive Financial Aid, students are required to make progress toward completion of their educational goals to continue to receive Financial Aid. For more information, click here.

Students that fail to maintain SAP may re-establish their eligibility for financial assistance you have the ability to file an SAP Petition Form. SAP petitions lets’ students explain the reasons why they didn’t do well in school. All petitions are reviewed in a timely manner and if approved, students can be placed on a plan that allows students to get financial aid as long as you make steady progress towards successful completion of your program.

Textbook Information

Student can access each semester’s book list via the campus Las Positas Bookstore.  Not all classes listed require texts.  Book information is listed as it becomes known through the submission of book orders from faculty. The book list is subject to substantial change prior to, and through the course of a semester. Contact your instructor for a complete list of materials required for the course. Transfer Credit Policies and Articulations Agreement

If you have attended college(s) prior to attending your home college, whether or not financial aid was received at the other college, and you plan to use transfer credits toward a degree/ certificate from the Las Positas College, you must submit official transcripts to the Admissions and Records department for evaluation. For Financial Aid purposes, all recorded applicable degree/certificate transfer credits will be computed toward the Satisfactory Academic Progress maximum time frame of 90 units for a standard 2-year program. You must inform your home college if you attended another college during the same academic year (i.e. Fall 2025 or Spring 2026 and summer 2026). Types of Financial Aid

To ensure eligibility for all available federal and state financial aid opportunities, students are required to submit an application every academic year. This can be done by completing the Free Application for Federal Student Aid (FAFSA) or, for AB540-eligible students, the California Dream Act Application (CADAA). Submitting these applications annually ensures that students remain eligible for grants, loans, scholarships, and work-study programs that can help cover the cost of their education.

Las Positas students may be eligible for various types of aid to help cover tuition, fees, & other college expenses. Here is a brief overview of the financial aid options available at Las Positas College:

Vaccine-Vaccination Mandate

As a condition of, and, for permission to access all properties controlled by the Chabot-Las Positas Community College District (CLPCCD) all students must provide proof of “full” COVID-19 vaccination (as defined by the U.S. Center for Disease Control) or submit a request for exception on medical, disability, religious grounds, or a deferral based on pregnancy. In addition, everyone, regardless of vaccination status, will be required to properly wear face masks that always cover mouths and noses while on CLPCCD-controlled property. Veterans Educational Benefits

Las Positas College is proud to have a Veteran’s Resource Center. If you served on Active Duty, you might be eligible for education benefits offered by the Department of Veterans Affairs. For example, the Post-9/11 GI Bill provides financial support for educational and housing expenses to individuals with at least 90 days of aggregate service after September 10, 2001, or individuals discharged with a service connected disability after 30 days. You must have received an honorable discharge to be eligible for the Post-9/11 GI Bill.

If you are currently serving in the military, you may be eligible for funding offered through the Department of Defense Tuition Assistance program. Check your eligibility status and the amount for which you qualify with your Service prior to enrolling. If you are the spouse or child of a service member who is serving on active-duty Title 10 orders in the paygrades of E1-E5, O1-O2, or W1-W2, you may be eligible for financial assistance from the Department of Defense for education, training, and/or the occupational license and credentials necessary for a portable career. If you are the spouse or child of a service member, you may be eligible for transfer of the service member’s Post-9/11 GI Bill benefits to you.

Voter Registration Information

Las Positas College encourages eligible students to register to vote. Students wishing to register may visit registertovote.ca.gov for more information. The Student Government also organizes voter registration events periodically throughout the school year.

Withdrawal Procedure

Dropping or withdrawing from a course is not an automatic process. It is the student’s responsibility to drop the classes he/she is not attending. If the student does not drop a class, he/she will be charged and could receive an “F” grade that will appear on their transcript.
